ChoreQuest Terms of Service

By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance and Eligibility

A. Age Requirement

You must be at least 18 years of age to create a ChoreQuest account or use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

ChoreQuest is designed for parents and legal guardians to manage household responsibilities for their children. Children under 18 do not create accounts. Child profiles are created and managed entirely by the parent or legal guardian account holder.

If we discover that an account has been created by someone under 18, we will terminate the account and delete all associated data without notice.

B. Legal Authority

If you are creating an account on behalf of a family household, you represent that you have the authority to bind yourself and the members of your household to these Terms.

C. Acceptance

By clicking "Create account," completing the account registration process, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Description of Service

ChoreQuest is a family chore management web application that allows parents and legal guardians to:

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time with or without notice, though we will make reasonable efforts to notify you of material changes that affect your use of the Service.

3. Account Registration and Security

A. Account Creation

To use ChoreQuest, you must create an account by providing a valid email address and password. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

B. Email Verification

We require you to verify your email address before you can complete your account setup. This is a security measure and a component of our COPPA compliance practices. You agree not to create an account using a false or impersonated email address.

You are responsible for maintaining the security of your account, including:

D. One Account Per Family

Each family household should maintain one ChoreQuest account. You may not create multiple accounts for the same household or use another person's account without their permission.

Your account is personal to you and may not be transferred to another person without our prior written consent.

4. Child Profiles and Parental Responsibility

A. Parental Consent

By adding a child profile to your account, you represent and warrant that you are that child's parent or legal guardian and that you consent to our collection and use of the child's display name and in-app activity as described in our Privacy Policy.

We are not responsible for disputes, disagreements, or outcomes arising from the use of ChoreQuest within your family household. ChoreQuest is a tool to facilitate family chore management — the nature of the chores, the coin values, and the rewards are entirely within your control and discretion as a parent.

5. Subscription Plans and Payment

A. Free Tier

ChoreQuest offers a free tier that includes core chore tracking features: creating chores, assigning them to children, children marking chores complete, parent approval, and coin balance display. The free tier is offered at no charge and is available indefinitely unless we discontinue it with reasonable notice.

B. Premium Subscription

ChoreQuest Premium unlocks additional features including the rewards catalog, coin redemption by children, and reward approval by parents. Premium is available on a subscription basis at the following rates:

Pricing is in US dollars. We reserve the right to change pricing at any time. If we change your subscription price, we will notify you at least 30 days in advance and your new price will take effect at your next billing cycle. If you do not agree to a price change, you may cancel before the new price takes effect.

C. Billing and Payment

Subscription fees are billed in advance on a recurring basis (monthly or annually depending on your plan). Payment is processed by Stripe, our third-party payment processor. By subscribing to Premium, you authorize us to charge your payment method on a recurring basis.

You are responsible for maintaining a valid payment method on file. If your payment fails, we will attempt to notify you and may retry the charge. Failure to maintain a valid payment method may result in suspension or downgrade of your Premium features.

All fees are exclusive of applicable taxes. You are responsible for any applicable taxes based on your location.

D. Free Trials

If we offer a free trial of ChoreQuest Premium, the trial period will be specified at the time of sign-up. When your trial ends, your subscription will automatically begin billing at the applicable rate unless you cancel before the trial expires.

E. Cancellation

You may cancel your Premium subscription at any time through the Stripe customer portal, accessible from within your ChoreQuest account settings. Cancellation takes effect at the end of your current billing period. You retain access to Premium features until the end of the paid period.

Canceling a subscription does not delete your account or family data. Your account reverts to the free tier at the end of the billing period. Premium features (including the rewards catalog and redemption history) become inaccessible but the underlying data is retained and will become accessible again if you resubscribe.

F. Refunds

All subscription fees are non-refundable except as required by applicable law. We do not offer partial refunds for unused time in a billing period. If you believe you were charged in error, contact [email protected] within 30 days of the charge and we will investigate.

As an exception to the above, if you cancel within 48 hours of your initial subscription purchase and have not made substantial use of Premium features during that period, you may request a full refund by emailing [email protected].

G. Chargebacks

If you initiate a chargeback or payment dispute with your bank or card issuer, we reserve the right to suspend or terminate your account pending resolution. Fraudulent chargebacks may result in permanent account termination.

6. Acceptable Use

A. Permitted Uses

You may use ChoreQuest solely for lawful personal, non-commercial household management purposes consistent with these Terms.

We reserve the right to suspend or terminate your account without notice if we determine, in our sole discretion, that you have violated these Terms. We may also report violations to law enforcement where appropriate.

7. User Content

A. Content You Create

You may enter text content into ChoreQuest including family names, child display names, chore titles, chore descriptions, and reward titles ("User Content"). You retain ownership of User Content you create.

B. License to Us

By creating User Content, you grant us a limited, non-exclusive, royalty-free license to store, display, and transmit your User Content solely for the purpose of providing the Service to you. This license terminates when you delete the content or close your account.

C. Content Standards

User Content must not be illegal, abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable. Because child profiles interact with the Service, you are responsible for ensuring that all content you enter is appropriate for children in your household.

D. No Sensitive Information in Content Fields

Please do not enter sensitive personal information (such as Social Security Numbers, financial account numbers, medical information, or passwords) into chore titles, descriptions, reward titles, or any other free-text field in ChoreQuest. These fields are designed for household management purposes only.

E. Aggregate Data

We may use anonymized, aggregated data derived from usage patterns (such as the most commonly created chore types, without any identifying information) to improve the Service and for internal analytics. This data cannot be linked to any individual user, family, or child.

8. Intellectual Property

A. Our Property

The Service, including its design, code, features, logos, trademarks, text, graphics, and the "ChoreQuest" name and brand, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

If you provide us with feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free license to use that Feedback for any purpose, including improving the Service, without any obligation to compensate you.

9. Third-Party Services

ChoreQuest integrates with third-party services including Stripe for payment processing and Supabase for data storage. Your use of third-party services integrated with ChoreQuest is subject to those services' own terms of service and privacy policies. We are not responsible for the practices of third-party services.

In particular, by using ChoreQuest Premium, you also agree to Stripe's Terms of Service available at stripe.com/legal.

10. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that:

We make no guarantee regarding its effectiveness in improving household chore completion, children's behavior, family dynamics, or any other outcome in your household. The efficacy of chore management and reward systems depends entirely on how you implement and use the Service.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF:

You agree to defend, indemnify, and hold harmless ChoreQuest and its owner, officers, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

13. Service Availability and Maintenance

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

14. Account Termination

We reserve the right to suspend or terminate your account and access to the Service, with or without notice, if:

If we terminate your account for reasons other than your violation of these Terms, we will provide a pro-rated refund of any prepaid subscription fees for the unused portion of your current billing period.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including but not limited to Sections 8, 10, 11, 12, and 15) shall survive.

15. Governing Law and Dispute Resolution

A. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

B. Informal Resolution

Before filing any formal legal claim, you agree to contact us at [email protected] and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally. We will make a good-faith effort to resolve disputes without litigation.

C. Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that you may bring claims in small claims court if your claims qualify.

The arbitration shall be conducted in English, in the State of California. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

D. Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST US. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

E. Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

A. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and ChoreQuest regarding the Service and supersede all prior agreements and understandings.

B. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

C. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver of any right or provision is only effective if made in writing and signed by an authorized representative of ChoreQuest.

D. Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

E. Force Majeure

We are not liable for any delay or failure to perform our obligations under these Terms to the extent caused by events beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or failures of third-party service providers.

F. Notices

Notices to you will be sent to the email address associated with your account. Notices to us should be sent to [email protected]. Notices are effective when sent by email or when posted to mychorequest.com.

G. No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.
